Apple faces class action lawsuit over water damaged iPhone

Apple is facing a class action lawsuit over its advertising of the iPhone’s water resistance. The company claims that the iPhone is resistant to certain water conditions, but says that damage caused by exposure to water is not covered under its warranty.

This controversial issue was brought to court by Joey Zukran , a lawyer based in the Canadian province of Quebec . Zukran argues that Apple’s advertising of water resistance, but its exclusion of water damage from the warranty, misleads consumers.

The case stems from a 19-year-old student who dropped his iPhone into a pool while on vacation in Mexico. After the phone fell into the water and stopped working, the student took his device to Apple and was told it was out of warranty due to water damage. Apple’s advertising, however, stated that the iPhone could withstand a certain depth of water.

Zukran wants to take the case to class action status, and for a reasonable reason. He wants Apple to extend its warranty coverage to water damage, and he also wants $500 in compensation to users who had their devices repaired or had to buy a new device due to water damage.

This isn’t the first water resistance lawsuit filed against Apple. A similar class-action lawsuit was filed in the US in 2022, but it was dismissed for lack of evidence. In 2020, an Italian regulator fined Apple €12 million for exaggerating the iPhone’s water resistance and failing to clearly state that it was only valid under laboratory conditions.
