Tesla continues to make headlines with lawsuits. Elon Musk’s electric car company has filed a new lawsuit in India. According to a report heard in the Delhi High Court, Tesla is demanding that a local battery manufacturer change its name.
Tesla vs. Tesla Power India confrontation
The hearing held in India brought Tesla and Tesla Power India Pvt Ltd brands face to face. The initial trademark dispute revealed that the battery manufacturer had unfairly used the “Tesla Power” brand.
In April, the Delhi High Court issued a decision requiring Tesla Power to withdraw certain advertisements and abandon the “Tesla Power” slogan. However, the electric car giant stated that this decision had not been implemented.
In its statement regarding the lawsuit, Tesla argued that the use of this name by the Indian company caused confusion in the market and constituted a trademark infringement. Tesla requested both compensation and permanent injunction to prevent Tesla Power India from using the brand name.
However, the Indian company stated that its field of activity is battery production and that it does not intend to enter the electric vehicle segment. This implies that the allegations of confusion among customers in the market are unfounded.
The judge overseeing the case has given Tesla Power India three weeks to provide an official response. Tesla also stated that it discovered the trademark infringement last year and attempted to resolve the issue before resorting to legal action. Despite this, the battery manufacturer did not abandon its brand.
