Apple will be sued in a class action lawsuit. A judge ruled that Apple’s attempt to dismiss the class action failed, stating that the plaintiffs had made sufficient allegations of “negligence and product liability”, Bloomberg reported.
Apple to go to trial over use of AirTags to track people
The lawsuit alleges that the AirTag, which has a price tag of just $29, has become a tool for stalking and harassment. In the lawsuit, which was first filed in December 2022, the plaintiffs accuse Apple of releasing AirTags without taking adequate measures to prevent their use for stalking.
In the lawsuit, the plaintiffs allege that Apple’s design of the AirTag is defective because the product did not and does not work more securely than expected when used or misused by a normal consumer.
In its motion to dismiss the lawsuit, filed in October 2023, Apple stated the following: “Plaintiffs’ lawsuit is a misguided effort to hold Apple legally liable for the intentional misuse of its products by third parties for unauthorized tracking.”
Apple condemns the misuse of its products in the strongest terms and has been willing to assist law enforcement agencies in investigations into complaints of unwanted tracking.
Shortly after AirTag’s debut, Apple added a number of additional security features in February 2022. These changes included improved tracking alerts and notifications, updates to how AirTag sounds when it leaves its owner, and more.
Apple’s class action lawsuit over AirTag continues to be an important case that could affect the current and future outcomes of the cases that follow.
