According to the new agreement, Nintendo is no longer just closing online services against the use of pirated content. The company also reserves the right to disable digital content used without permission.

This provision is especially included in the UK version of the agreement. In the US user agreement, it is clearly stated that if pirated activity is detected, the console can be rendered completely or partially inoperable. This situation shows that a system that prevents the physical use of the console can be activated.
Nintendo used to take measures such as suspending or completely blocking access to online services before. However, with the new console, system-level restrictions have come to the fore.
When users are detected to have violated digital rights, the device can be restricted by intervening in the hardware. This move aims to prevent the use of unlicensed games in particular.
However, some analysts point out that Sony has done a similar application in the past via PlayStation Network, but then faced some lawsuits and had to pay compensation. If Nintendo follows a similar path, it may face some legal risks.
