The European Union is preparing to impose a fine exceeding $1 billion on Elon Musk’s social media platform X for violating the Digital Services Act. As a result of the investigation launched by the EU Commission, the platform’s deficiencies and inadequacies in content moderation were clearly identified.

This step has the potential to create a new crisis not only for the future of the platform, but also in relations between the EU and the US. The Commission had been monitoring changes to X’s content moderation policies since 2023.

The failure to prevent illegal and misleading content that spread rapidly on the platform during the conflicts between Hamas and Israel was cited as the main reason why EU authorities initiated the infringement procedure.
The transparency reports, risk analyses and responses to the Commission’s requests for information submitted by X were found inadequate. In addition, the “Community Notes” system, which works with user contributions, was found to be ineffective. According to EU sources, this sanction will not be limited to a fine.
At the same time, the platform will be required to implement some product and system changes. This would be one of the most comprehensive sanctions ever proposed under the Digital Services Act. The regulations impose heavy responsibilities on digital platforms, especially in terms of preventing disinformation, removing illegal content and ensuring user safety.
